According to an article in the Wall Street Journal this week, nagging is one of the primary causes of divorce. Also, the article suggests that nagging is more common than adultery and that women are more responsible for nagging than men! Check out the article for yourself at http://www.online.wsj.com/.

Look, even though I am a man, I cannot defend "my kind" by simply agreeing with this article's conclusions! First of all, as Augusta, Georgia divorce lawyers, we find that there are many other more prominent causes of divorce, including money issues, control issues, and lack of communication. Also, we believe that men are just as prone as women to nag or complain about their spouses!

Celebrity Marriage and Divorce: Jerry Seinfeld

Last evening, I enjoyed a live concert performed here in Augusta, Georgia by one of my favorite comedians: Jerry Seinfeld. I believe the Seinfeld sitcom remains one of the best in television history! During the question and answer session, following his hilarious stand-up act, Jerry pointed out that he has been happily married for twelve years. Of course, that didn't prevent him from making a few funny jokes and observations about marriage and divorce!

To paraphrase Jerry, he observed that marriage is about two people trying to get along without saying, "I hate you!"

As Augusta, Georgia divorce lawyers, we often hear from folks who, for many different reasons, couldn't accomplish that goal. But maybe Jerry was right about marriage and divorce! What do you think?

Adultery Around the World: The Case of Sakineh Ashtiani

As Augusta, Georgia divorce lawyers, we sometimes receive questions about the consequences of adultery in Georgia divorce cases. And the consequences of cheating, if proven, can be serious in a divorce. But everything is relative. Have you been following the tragic case of Iranian prisoner Sakineh Ashtiani? This poor Iranian woman was convicted of adultery in Iran back in 2006 and, incredibly, the Iranian government has been trying to put her to death ever since!

Initially, she was sentenced by Iranian authorities to death by stoning. Perhaps international pressure and focus on the case has prevented that unjust, inhumane outcome. But now, this week, the Iranian Judiciary has announced that it is considering death by hanging as an alternative punishment. This is outrageous!

Hopefully, the international spotlight will remain focused on this tragic case and will cause the Iranian Judiciary to back away from this proposed punishment for alleged adultery, too.

So, as you can see, while you should be concerned about and you should discuss the consequences of adultery with your own divorce attorney, at least, here, and in most other parts of the civilized world, no one faces the death penalty for it. And that's the way it ought to be. Don't you agree?

According to various news reports, actress Debra Messing, star of the popular t.v. sitcom Will & Grace, separated earlier this year from her husband of ten years, Daniel Zelman. The couple has one son.

This appears to be yet another example of a Hollywood couple which has quietly separated this year without immediately attracting media attention.

As you probably know, Ms. Messing has had a number of major acting roles and has also won an Emmy for her fine work. I especially enjoyed her portrayal of Lisa Kramer in the Ben Stiller comedy, Along Came Polly. You will recall that Messing's character cheated with the French scuba instructor, (played by actor Hank Azaria), while on a honeymoon with her (movie) husband, Reuben Feffer, (played by Stiller).

Hopefully, Ms. Messing (and her soon-to-be ex), will each continue to find happiness and success in their respective careers.

Celebrity Break Ups and Separations

Have you heard the news? According to various reports, actor-playwright Sam Shepard and his long-time companion, award-winning actress, Jessica Lange, had split up approximately two years ago. The talented couple had reportedly been together as a couple for nearly three decades before the break up. Shepard will always be one of my favorite actors for his portrayal of Chuck Yaeger in The Right Stuff.

One thing about this news report which most surprised me is that it took Hollywood's inquiring minds two years to learn about and report it! You should check out all the amazing work done by these two fine actors, including Ms. Lange's incredible charitable efforts.

Here's hoping that they both have moved on and found happiness.

Divorce and Georgia's Child Support Guidelines

(Our divorce lawyers--father and son--offer free initial consultations in Georgia divorce cases). Many of the callers have good questions about how much child support they can expect to receive, following their divorce, and how the child support is calculated. Here are a few tips about child support in Georgia:

1. First of all, it is important to understand that Georgia no longer simply bases child support on the income of the non-custodial parent. Instead, a few years ago, Georgia elected to go to and utilize the current child support guidelines, which take both parents' incomes into account. If one of the parents is unemployed, sometimes, the judge will impute minimum wage to that parent in making the calculation.

2. Second, while it is possible for anyone to figure out for themselves how to work through the child support guidelines, in many divorce cases, the guidelines can be complicated, or difficult, to follow. As a result, we recommend that you retain your own divorce lawyer to help you with child support issues, along with all other issues in your divorce.

Consider the following reasons, (among many others), as to why divorce lawyers sometimes take depositions:

Sometimes, it becomes necessary to try to pin down a spouse about how and where they have spent money, or who they spent it on. As Augusta, Georgia divorce attorneys, we often assist our divorce clients by resolving various issues in their divorce cases through mediation. Mediation is a form of alternative dispute resolution in which a neutral party, the mediator, facilitates an open dialogue between the parties, (and their divorce lawyers), with a goal of resolving disputed issues without a trial.

Our Augusta, Georgia judges generally require mediation to be tried before they will allow the parties to proceed to a final hearing.

Of course, there are many trained mediators who are skilled at getting warring litigants to the table to discuss possible solutions to their cases. As divorce attorneys, we often marvel at how some mediators are gifted in getting some difficult cases settled!

While this formal mediation works in some cases, this is not the only method of settlement. Informal mediation, without a mediator, is still available. In short, as divorce lawyers, we sometimes attempt informal mediation to resolve issues, such as alimony, and debt, or property, division. In other words, we simply arrange a face-to-face meeting, (in some divorce cases), with the other divorce attorney and their client, (and us with our client), and simply sit down, across a conference room table, (without a go-between, or mediator), and attempt to negotiate a settlement on our own.

Informal and formal mediation do not work in every divorce case. If not, you may still have to go to a final hearing, or trial, and let the judge make the call. We recommend that you discuss each of these mediation ideas or methods with your own divorce lawyer.

Celebrity Separations and Divorces: The Kim Kardashian Saga Continues!

During the past week, the news reports have kept on churning out about Kim Kardashian's decision to file for divorce, after only 72 days of marriage, from pro basketball player Kris Humphries. For instance, there have been reports that the Kardashians have made millions off the recent t.v. marriage. Some also claim the marriage was a sham in the first place. (The Kardashians have adamantly denied these reports and, frankly, we submit that no one in the media really knows what they are talking about).

Also, Kim reportedly flew to Minnesota, (where Kris is reportedly from), during this past week, to seek marriage counseling with Kris, and aided by the pastor who presided over their ill-fated marriage.

In addition, the Kardashians bore the brunt of a very unflattering spoof performed by various cast members on Saturday Night Live.

Finally, today, I have read reports about an alleged "backlash" by a cynical public against the Kardashians over what has been reported by some as a sham marriage. Again, in my opinion, while the cynics might be right about some things, no one really knows the truth here. Is it all just a public relations disaster? In my opinion, no one knows other than Kim and Kris, and those are really the only two people who can work to resolve this matter, one way or the other.

Wow! I am sure you have heard the various news reports, by now, indicating that model and reality star Kim Kardashian has filed for divorce from her pro basketball husband, Kris Humphries, after only 72 days of marriage. According to reports, the divorce filing by Ms. Kardashian cites "irreconcilable differences."

Again, Ms. Kardashain has filed for divorce after only 72 days! What is your opinion? Isn't it possible, in some marriages, that some spouses realize, early on, that a mistake has occurred, and that it is best to end a marriage sooner, rather than later? Are there other possible reasons? Are there better solutions? What do you think?

I had an interesting experience last evening. I was invited to be the guest speaker to field questions on the local "Law Call" television show. I'll bet you have a similar t.v. program where you live. Folks call in and ask a lawyer about their law-related questions.

One of the interesting features about this t.v. experience was that I learned you have time for only a few questions. And when technical problems with the telephone lines occur, I learned you must be flexible and keep going on!

One question I answered dealt with the difference between an uncontested and contested divorce. Of course, each of you who follows this divorce blog already knows the difference!

How Long Does It Take For A Georgia Divorce To Become Final?

As Augusta, Georgia divorce lawyers, we are often asked, "How long will it take for my divorce to become final?" The answer is.....it depends!

Actually, the length of a divorce proceeding may depend, in part, on whether it is an uncontested divorce or contested divorce.

1. SIMPLE, UNCONTESTED DIVORCES:

A simple, uncontested divorce in Georgia will generally take only a couple of months, after filing, in order to become final. In other words, under Georgia law, generally, the divorce documents must remain in the clerk's office for a month before the file can be sent by the clerk to the judge's office, where it might take up to another month, or so, before a final divorce decree is signed. Of course, if there are any problems, such as one of the parties is late in getting the mandated children of divorce seminar completed, then the divorce could take longer before it is approved by the court.

2. CONTESTED DIVORCES:

Contested divorces are a different ballgame! It is much more difficult, as a Georgia divorce attorney, to predict how long a contested divorce might take. More simply put, we generally will not even attempt to guess! In part, the length of time it takes will depend upon the reasonableness of both parties. In other words, if both parties can cooperate and quickly negotiate a fair settlement, then a contested divorce can be resolved relatively quickly. However, if the parties are fighting each other, tooth and nail, on complex issues ranging from child custody, to property division, to alimony, to adultery, to who gets the family cat, then it might take a number of months, or even a year, or more, of hearings and mediation, before the final decree is signed! In short, every divorce is different, so it is impossible to guess precisely how long the entire process will take.

Of course, these are all matters which you should discuss with your own divorce lawyer!

But it might surprise you to learn that we get a lot of hits from people wanting to know if you can go to jail, or to Hell, for committing adultery!

What common key words lead folks to your blog?

Divorce, Child Custody Battles, and the Seal Beach, California Shooting Incident

At the time of this posting, while the reported details are still sketchy, it appears, based upon various news reports, that the tragic shooting and killing of eight people by a lone gunman at a Seal Beach, California beauty salon, Salon Meritage, may have been related to a child custody battle. In short, based upon initial reports, it appears that a 42 year-old man, Scott DeKraai, who was arrested by police less than a mile away from the salon, had reportedly been engaged in a bitter child custody battle with a salon employee over their son.

Look, no one know if the initial news reports are true. And naturally, no one should contest the fact that Mr. DeKraai is entitled to his fair day in court. But it is also true, as this tragic incident may illustrate, and as every divorce lawyer knows, child custody battles can sometimes get ugly -- really ugly. And sometimes, sadly, child custody disputes lead to violence.

Are there any solutions? Perhaps we can consider that topic on another day. But today, our thoughts and prayers go out to each of the victims of this tragedy and to each of their families.

How to Determine the Duration of Alimony and New Trends

THE DURATION OF ALIMONY AND THE NEW TREND:

As Augusta, Georgia divorce attorneys, we are often asked by folks about how Georgia judges (or juries) determine the amount of alimony in a divorce case and how long such alimony must be paid. Today, let's focus only on the latter question -- about the length or duration of alimony. Simply put, generally, in Georgia, while there are guidelines, a judge has complete discretion to determine how long he or she believes alimony should be paid. Put another way, while a judge will consider the length of the marriage, and the parties' needs and ability to pay, (among other factors), in determining the amount of alimony, the judge generally also has a lot of discretion in determining the length of time or duration in which it must be paid.

But judges have common sense. For example, in theory, it is possible that a party in a short-term marriage of two or three years could get permanent alimony. But that is not likely to happen. However, the point is that, in Georgia, generally, judges retain complete discretion to decide the duration of alimony. But that's in Georgia. What about other states? Are there any new trends or new approaches in states' alimony statutes?

FLORIDA'S NEW ALIMONY STATUTE:

In Florida, in 2010, their state legislature reportedly enacted a new alimony statute which essentially divides marriages into three categories, based upon duration. Short-term marriages are defined as marriages less than 7 years; moderate, 7-17 years; and long-term marriages are defined as longer than 17 years. These three categories, in turn, help determine the duration of alimony payments.

MASSACHUSETTS' NEW ALIMONY STATUTE:

Also, in Massachusetts, just last week, their state legislature passed a new law which similarly limits the duration of alimony payments based upon the length, or duration, of the marriage. For instance, now, in Massachusetts, for long-term marriages, (i.e. defined as being more than 20 years), alimony will end at retirement age. And now -- get this -- under their new law, if you have been married for 5 years, or less, the duration of alimony will now reportedly be automatically capped at 50% of the number of months you were married.

In other words, there appears to be a trend toward "fixing" alimony statutes by limiting a judges' discretion as to the duration of alimony. Of course, you should consult with a divorce lawyer in your own state about your own state's laws about divorce and alimony!

What is your opinion of this trend and these statutory changes in some states which limit the duration of alimony based upon the duration of the marriage? Should their be statutory limitations, or should judges retain the discretion to decide how long alimony should be paid?

Of course, if you were married to a worthless spouse, like "Sluggo," you would be happy if he would get off his lazy "trend" and make even one alimony payment!

Celebrity Divorces and Separations: James Marsden and Lisa Linde

Well, it appears that another Hollywood marriage has bitten the dust. According to various news reports, Lisa Linde, the spouse of actor James Marsden since 2000, filed for divorce last week from the popular actor and star of Straw Dogs and the X-Men films. The couple have two children. Ms. Linde is the daughter of famous country music singer Dennis Linde.

According to a representative for the couple, while the marriage may be broken, the couple will remain "good friends." That statement sounds good, doesn't it? But is it really true?

Hopefully, they will, in fact, remain "good friends." Don't you agree that it is possible for a divorcing couple, at a minimum, to at least mildly tolerate each other, for the sake of their children?

Celebrity Separations and Divorces: Demi Moore and Ashton Kutcher

I am sorry I have been away from the blogging world for the past week! As an Augusta, Georgia divorce lawyer, (who also handles personal injury, criminal defense, and countless other legal matters), I have really been busy! I feel like I have been jumpin' and steppin' on alligators all week -- with both feet! But it's nice to be back to blogging!

Have you heard the news reports about an alleged potential split between Hollywood actors Ashton Kutcher and Demi Moore? You will have to read elsewhere about all the sordid allegations -- including allegations of adultery. In fairness, probably no one in the entertainment media really knows the truth about such allegations. But smut --whether true or not -- sells rags, doesn't it? However, in any event, such smutty allegations are not the point of this post, anyway.

The point of this post is that, as the Moore-Kutcher marriage has clearly demonstrated, (at least, until now), marriages between older women and younger men can, and do, work. As you may know, Ms. Moore is 48; Ashton Kutcher, the new star of Two and a Half Men, is only 33. They have been married for 6 years. Reasons Why People Divorce: The Mysterious Case of the "Lovey-Dovey Divorce"

As Augusta, Georgia divorce lawyers, we never know what to expect when divorcing couples walk in the door to sign their uncontested divorce documents. What will be their reactions, or emotional state? In some divorces, the parties are understandably upset. In other divorce cases, one party, or the other, may be angry. And sometimes, they simply remain silent, or stoic. But then, there is that one case, as a divorce attorney, which I will never forget. It was the case which I call the "lovey-dovey divorce."

It was a bright, sunny day--just a couple of years ago. The two parties had arrived at our law offices separately. Looking out my office window, I could see them, husband and wife, as they paused and warmly embraced, before they entered. Then, they walked into our offices, hand-in-hand, together.

While going over the divorce documents, it appeared that they could not keep their hands off each other. He laughed at her witty quips. They also freely smiled at each other. In short, they looked more like excited, new lovers than a couple going through a divorce! But in spite of all their smiles and touches, and their furtive, flirting glances, they each dutifully signed the divorce documents and left!

After they left, I couldn't resist my own furtive glance out the window. There, I witnessed another warm embrace. Finally, they each got into their own automobiles and drove away, separately.

Why were they so happy and so warm to each other? Why were they getting a divorce? What do you think? We will never know! But this was the case of the "lovey-dovey divorce!"

According to various reports, this past week, Rev. Robertson essentially told viewers of "The 700 Club" television program that it is okay to divorce your spouse, if he or she has Alzheimer's disease, because the condition is a "kind of death." In fairness, he added that you should first make sure that your sick spouse is taken care of. But what do you think of his controversial views about divorce from a dying spouse?

Celebrity Separations and Divorces: Brad Pitt and Jennifer Aniston

Why do some celebrities have to open their mouths and bash their exes? If you believe actor Brad Pitt, he opened his mouth this week, during an interview for this Sunday's Parade magazine, but he didn't intend to bash his ex, actress Jennifer Aniston.

Of course, Pitt and Aniston were married from 2000 until 2005, when he met his new (and current) girl friend, Angelina Jolie, on the movie set of Mr. and Mrs. Smith. (It is also important to point out that Pitt and Jolie have denied they committed adultery before Pitt and Aniston were divorced).

But you read the interview and decide for yourself about Pitt's comments and whether or not they were directed, in any way, at Aniston. According to various news reports, during the interview, among other things, Pitt described his life, while he was married to Aniston, as dull and "pathetic."

Since the interview, Pitt has tried to make amends, by complimenting Aniston, and by emphasizing that he was only talking about his own life and career, and not about his marriage or about Aniston.

Who knows? Maybe, Pitt's explanation is correct. Maybe he wasn't bashing Aniston. But maybe this incident also illustrates that celebrities, just like regular folks, should simply not open their mouths and say anything which could ever be construed as negative about their exes! And this rule is especially true if the party was once married to, and then divorced, "America's Sweetheart!"

Celebrity Separations and Divorces: Eva Longoria and Tony Parker

Sometimes, celebrities must try to answer some really dumb questions from the media! If you were asked, like actress Eva Longoria, following a recent divorce, whether you would ever marry again, what would be your answer?

According to various news reports, Ms. Longoria gave a pretty good response to this question, in my opinion. She basically said that she has not given it a lot of thought and that no woman, after recently getting a divorce, could really give a truthful answer!

Don't you agree that this is a fair response? After all, Ms. Longoria's divorce from basketball star Tony Parker was just finalized earlier this year. And while we all can probably safely predict that the Desperate Housewives star will not be desperate to re-marry any time soon, it is equally true that no one, including her, (or you, if you have recently gone through a dvorce), knows what the future may hold.

So, that is why, in my opinion, as an Augusta, Georgia divorce attorney, Ms. Longoria gave a truthful response to a dumb question!

Divorce, Child Support, and Advice to Deadbeat Dads

As you can imagine, because we are Augusta, Georgia divorce lawyers who offer free initial consultations, every day, we receive numerous telephone and email inquiries about Georgia divorces. In response, we earnestly attempt to give good, sound information about Georgia divorce law. Also, we always encourage each caller or writer to discuss their divorce questions with their own divorce attorney. Finally, we also always try to be polite to callers and writers to the Goolsby Law Firm, LLC!

Sometimes, we get questions about divorce which stump us. In other words, divorce attorneys are not legal encyclopedias. We simply do not always have the answers without doing legal research.

And sometimes, we get questions for which there are no good responses, or, at least, there isn't a response which the caller or writer wants to hear. One example of this type of question involves inquiries from so-called "deadbeat dads." I really don't like to use this term, because, as I have explained before, it unfairly casts a shadow over all dads and ignores the fact that most fathers DO, in fact, support their children.

But a fairly common question we receive from some so-called "deadbeat dads" is: "How can I surrender my parental rights?" The answer we generally give is: "You can't!" In other words, generally, no Georgia judge would (nor should) allow a father to avoid paying child support and simply walk away from their parental responsibilities. If your spouse won't allow you child visitation, then, generally, your best remedy is to take 'em back to court, in a contempt action, rather than to try to avoid paying child support!

Sometimes, I also want to add that I believe the caller or writer should stop procreating and should consider getting a vasectomy! But I generally keep such advice to myself! Like I said, we always try to be polite to callers and writers to the Goolsby Law Firm, LLC!

Divorce, Anger Management, and Driving Cars Through Courthouses

Have you ever gotten so angry that you have completely lost control of your temper and every shred of your common sense? Divorce can apparently do that to some people.

According to news reports, a South Georgia bailiff, reportedly angry about a recent divorce, got so angry that he attempted to drive his Mercedes through a courthouse entrance. Fortunately, a brick planter stopped his futile effort. But unfortunately, the poor man now reportedly faces criminal charges, in addition to whatever problems got him so upset about his divorce.

As Augusta, Georgia divorce lawyers, we see it all. We often see folks who maintain an incredible calmness, even while their angry, worthless spouses harass and bedevil them. But we also sometimes see people get as mad as wet hens when they are wronged by their spouses, or exes. And we also sometimes see people held in contempt of court because of their anger management issues. The point is that you should get control, and get help, but not get even.

Another related point is that, if you are going through a divorce, you should never let your temper get you into trouble. Then, you still have your original problems, plus, like this poor South Georgia man, you also have your new problems, too! And that may include having to get your Mercedes fixed, too!

Celebrity Separations and Child Custody and Visitation Issues: Halle Berry

An interesting issue involving child visitation was illustrated in a news story reported by TMZ this week. According to TMZ and other news sources, Academy Award-winning actress Halle Berry was back in court this week with her lawyers to settle a child visitation issue with model Gabriel Aubry, her former lover and the father of their three year old child. The issue reportedly involved how much visitation Mr. Aubry can have with their child while Ms. Berry is away filming movies.

Although you may not be a movie star, a similar issue can arise following your separation or divorce, too. For instance, if you have primary physical custody, but you have a job which sometimes takes you out of town, your ex may seek additional visitation rights. In other words, your ex may seek, in a divorce modification action, additional child visitation rights, (or may even seek a change as to child custody). Generally, your ex's argument will be that having the child stay with a parent, (while you are away), is preferable to the child staying with other relatives or in daycare.

Of course, every family law case is different. In short, if this issue arises in your case, you should consult with your divorce lawyer as soon as possible. According to TMZ, Ms. Berry reportedly came out of this hearing pretty good, and you may come out okay, too!

Rumors of Celebrity Separations and Divorce: Will Smith and Jada Pinkett Smith

I am a big fan of actor Will Smith. While I wasn't crazy about his television series, Fresh Prince of Belair, I have really enjoyed several of his fantastic movies, including Men in Black and I Am Legend. So, I really hated to hear and read the reported Hollywood gossip about alleged problems in his 13 year marriage to fine actress Jada Pinkett Smith. I also hate it that, whether or not any of the rumors are true, the Hollywood press probably won't leave the couple alone.

We have discussed in this divorce blog before about all the stressors placed by Hollywood and by acting careers on celebrity marriages. Look, celebrity couples can have marital problems just like everyone else. And it may be true that many celebrity marriages do end in separation and divorce. But not all celebrity marriages end in separation or divorce. And it is equally true that it is a shame that Hollywood couples generally find it much more difficult than most other couples to address any potential issues in private.

Here's hoping that this fine acting couple will find some peace and happiness! What do you think? Don't you agree that, generally, the media spotlight could exacerbate any potential marital problems?

Filing For Divorce First: Does It Really Matter?

But we also enjoy including some practical divorce tips and information for you to discuss with your own divorce attorney. Today, we address the question of whether or not it matters who files for divorce first.

So, you have finally decided to divorce your worthless spouse, "Sluggo!" Now, you wonder -- does it really matter who files for divorce first? In other words, should you be concerned about racing Sluggo to the courthouse?

As an Augusta, Georgia divorce attorney, I can tell you that, generally, it does not matter who files for a divorce first. In other words, even if Sluggo files a divorce complaint and gets your served first, you and your divorce lawyer will still be able to file an answer and counterclaim, and set forth all your facts and legal arguments.

That being said, as a divorce attorney, I have also seen some circumstances in which filing first may provide some advantage. For instance, if you are concerned about your spouse moving away, then you should discuss with your divorce lawyer the importance of getting him or her served before they leave the area.

Also, in some cases, I have seen some psychological advantage in the idea of "going first" and getting Sluggo served first. In other words, in some cases, if Sluggo is a control freak and believes that he can control how and when you get a divorce, then there might be some advantage in taking away the control and having a deputy put divorce documents in his hands!

So, in the final analysis, in most divorce cases, it may not matter who gets to the courthouse first. However, in some divorce cases, there might be some advantage in filing first for a divorce and "making Sluggo's day!" Of course, every divorce is different and we recommend that you discuss all your rights and options with your own divorce attorney!

Is It Really "Your Thing?" Or Can You Really Cheat Or "Do What You Wanna Do" Before Your Divorce Is Final?

Do you remember the classic 1960's song, "It's Your Thing," by the Isley Brothers? If so, then you will recall that the song's lyrics essentially suggest that, because it's "your thing," then you can "do what you wanna do" and "sock it" to whomever you want and, presumably, whenever you want!

But is this song really true in all situations? More particularly, is it really "your thing," during a divorce, and can you "sock it" to whomever you want, and whenever you want, even before your divorce is final? In other words, is it okay to cheat, or commit adultery, even before the ink on your divorce decree is dry?

As divorce lawyers in Augusta, Georgia, in our opinion, our plain, simple answer to this important question is "NO!" It is NOT okay! In other words, generally speaking, (and from a legal standpoint), in a Georgia divorce, it is NOT okay to cheat, or date, or commit adultery, or run around, or do "your thing" until after your divorce is final! There are too many potential ramifications and too many potential adverse consequences, of cheating, to discuss here. Be sure to consult with your own divorce attorney. But a couple of examples should suffice.

For instance, proof of cheating, even long after the separation, might tend to support your spouse's claim that adultery also occurred before the separation. In addition, if you are out partying and "running around" while the divorce is pending, it could potentially have an impact on the issue of which party would make the best custodial parent in a child custody battle. Again, talk with your own divorce lawyer about this issue!

Look, as divorce attorneys, we realize that you are, in reality, going to "do what you wanna do." But our job, as divorce lawyers, is not to slap you on the back and approve everything you "wanna do." Our role is to provide information and sound advice, even if it is not what you want to hear.

Can you imagine my surprise when I recently read another divorce lawyer's blog in which that divorce attorney essentially suggested that it is okay to cheat during a divorce?! Actually, the lawyer basically suggested that it is okay to cheat before your divorce is final, but just don't get caught!

Well, you won't hear that same advice, or opinion, at the Goolsby Law Firm, LLC! As you know, we are divorce lawyers in Augusta, Georgia -- in the heart of the Bible Belt. Maybe things are handled differently in divorce cases in other places. And maybe it is okay to do "your thing" in other jurisdictions.

But in Georgia, if you are going through a divorce, again, you should discuss the potential impact of adultery on your divorce with your own divorce lawyer. And, if you ask us, from a legal standpoint, while it may be "your thing," you shouldn't "do what you wanna do," until after the divorce is final.

Divorce, Divorce Costs, and the "Good Old Days!"

Let's face it. Not everything was good about the "good old days!" But some things about getting a divorce were arguably better "way back when" than they are today. Frankly, in my opinion, as an Augusta, Georgia divorce lawyer, we all should take a few lessons from our grandparents about how lawsuits were handled "back in the day!"

Here are just a couple of examples of how we could improve divorce procedures. I got some of these ideas from a conversation I recently had with a kind, elderly gentleman who got a divorce over 65 years ago!

1. REDUCE THE AMOUNT OF DIVORCE PAPERWORK:

The increase in the amount and number of court documents and paperwork was one of the things I discussed with this elderly gentleman. Ideally, in my opinion, we should reduce the amount of paperwork in Georgia divorces. For example, this kind, elderly gentleman told me that, when he got a divorce back in the 1940's, the judge signed a divorce decree which consisted of only one page! Isn't that remarkable? As a Georgia divorce attorney, I fully recognize that we cannot (and should not) eliminate all divorce documents which are part of a typical modern divorce, including parenting plans, child support worksheets, and the child support addenda. Some change is good. But it would also be nice if some of the tangential divorce documents and forms could be streamlined, or eliminated.

2. REDUCE THE COSTS OF A GEORGIA DIVORCE:

Additionally, it would be nice if the costs of a Georgia divorce could be reduced. The elderly gentleman told me that, when he got a divorce 65 years ago, it cost only $35.00! Isn't that incredible? Now, we all know that $35.00 was still a substantial amount back then, but the costs of going to court have easily out-stripped inflation. One way to reduce the costs of a divorce would be for the Georgia General Assembly to reduce the amount of the court filing fee. Last year, (as I have complained about before in this blog), our legislature increased the filing fee for all civil lawsuits, including divorces, from $80.00 to a whopping $205.00! In my opinion, this filing fee increase was outrageous and unfair to Georgians who can no longer afford justice in this state.

A Divorce Lawyer's Take on "Do It Yourself Divorce" Kits

Everybody is into DIY (do-it-yourself) projects these days! I love to refinish antique furniture! But please let me explain why I believe DIY kits may not be the best way to go when you get a divorce in Georgia.

Okay, I realize that before I offer this critique of DIY divorces and divorce kits, some of you may think it is just sour grapes offered by a greedy divorce attorney! In other words, you may think I am just another divorce lawyer who doesn't appreciate the competition! But please believe me that that is not the case! I simply do not recommend that anyone should attempt to handle such an important, complicated legal matter without help from a professional.

For instance, in many divorce cases, both contested and uncontested divorces, there are generally a number of relatively complicated issues, such as child custody and child support. For example, no kit is likely going to tell you all the proper factors in calculating child support under the Georgia child support guidelines. Also, there are a number of requirements for a Georgia divorce which, in our experience, the so-called DIY divorce kits typically do not meet or satisfy. For example, no kit is going to tell you that, in a Columbia County divorce, you will need to submit a properly filled out summons, even in an uncontested divorce.

Finally, there is one additional reason why I believe DIY kits are not the best way to get a divorce in Georgia. This reason is that there are a number of divorce lawyers, including us, at the Goolsby Law Firm, LLC, who will handle simple, uncontested divorces for an affordable retainer that does not cost a lot more than many of the DIY kits!

So, have I convinced you that a do-it-yourself divorce is not the best way to go? Save your creativity for your home repair projects!

Celebrity Divorces: Lucille Ball and Desi Arnaz

Have you heard? Tomorrow, August 6, 2011, would have been the 100th birthday of talented actress and business mogul Lucille Ball! Sadly, Ms. Ball, one of my favoriote comedians, died of an aneurysm back in 1989.

I won't bore you with a lot of facts about her incredible life and Hollywood career. But did you know that her original television series, I Love Lucy, aired 180 episodes between 1951 and 1957? Did you also know that Ms. Ball and her first husband, (and co-star), Desi Arnaz, were married in 1940 and divorced in 1960? Ms. Ball later married a comic/businessman, Gary Morton, with whom she lived at the time of her death.

Most of you probably know that Ms. Ball was a trail blazer as a television business woman and founder of Desilu film production company. But did you know that, early in her career, Lucy starred in different films with both the Three Stooges and the Marx Brothers?

However, that's enough, today, of the facts about the stellar career of Lucille Ball. Today, I mainly just want to say: thank you, "Happy Birthday," and "I Love Lucy!"

Surprising Celebrity Separations and Divorce: Jennifer Lopez and Marc Anthony

Have you seen the latest edition of Vanity Fair? According to various news reports, talented singer and American Idol Judge Jennifer Lopez explains in Vanity Fair exactly why she and her husband of 7 years, Marc Anthony, recently split up. Among other reported reasons, Ms. Lopez indicated essentially that she realized she wasn't being treated properly and that she loved herself too much not to walk away.

What is your opinion of these cited reasons for this celebrity split? Also, have you noticed a trend these days that, after a separation or a divorce, many celebrities ultimately "go public" about the splitup, either in interviews, with celebrity interviewers like Oprah, or in "tell-all" books or magazines?

What do you think about this practice of celebrities "going public," rather than keeping such matters private? Of course, in their defense, because they are in the public eye, many celebrities probably realize that if they don't tell their side of it, then somebody else will gossip about it, or make up something anyway! So, perhaps celebrities might as well tell the truth and hope it slows down the rumor mills and "inquiring minds." What do you think?

IRS Announces New Innocent (Or Injured) Spouse Relief Policy

We are divorce lawyers, not tax lawyers, in Augusta, Georgia. However, we wanted to pass along to you, (for you to discuss with your own attorney), some information issued by the I.R.S. this week concerning "innocent spouse relief." This refers to the fairly common situation in which a divorcing spouse, even after they have gotten a divorce from their worthless spouse, "Sluggo," gets zapped by the I.R.S. for back taxes and penalties on income earned, but not reported, by Sluggo. According to the policy, in some cases, the I.R.S. will not hold the innocent spouse responsible for Sluggo's problems, provided the innocent spouse did not know, nor could have known, about the tax understatement by their ex.

The problem, in the past, for some innocent spouses, has been that there was a two year time limit in which to seek relief based upon this equitable ground. But now, thankfully, according to I.R.S. notice 2011-70, the two year time limit may be waived! Uncontested and Contested Divorces in Georgia: Divorce Lawyers And Pro Bono Divorce Cases

As you know, we are father and son divorce attorneys located in Augusta, Georgia, (and the Martinez, Evans, and Grovetown, Georgia areas). Every day, we handle a number of both uncontested and contested divorces, which involve a number of different issues, ranging from questions about child custody and child support, to child visitation and property and debt division matters.

As divorce lawyers, we also are keenly aware that many of our Georgia divorce clients are going through a difficult time, financially, due to the economy and their divorce. As a result, we sometimes get telephone calls from prospective divorce clients asking if we would be willing to take their divorce case "pro bono," i.e. for free.

The goal of this post is to attempt to explain why it is difficult for a Georgia divorce lawyer to agree to take a divorce case pro bono, or for free. One reason is that it really isn't just for free. In other words, the divorce lawyer would actually lose money, if he or she took the case pro bono. Let me explain. Even if the divorce lawyer charges no legal fees, the divorce lawyer would still actually go in the hole, if he or she must dig into their own pockets to pay for the divorce costs, including divorce filing fees, service fees, court reporter fees, guardian ad litem fees, and on and on!

Another reason why divorce attorneys generally don't take divorce cases on a pro bono basis involves the amount of time which some divorce cases take. In other words, if a pro bono divorce case takes up a large percentage of a divorce attorney's time, over several months, then it makes it more difficult for that attorney to pay the law firm's overhead. Put another way, time spent by a divorce attorney on a "free" divorce case could have been spent generating funds to pay the office overhead from "paying" cases. This may sound cold, or callous, but, simply put, like in any other business, if a family law law firm cannot pay its overhead, then it cannot keep its doors open to help anyone!

As a result, in my opinion, generally, it simply is not practical to ask or expect a Georgia divorce lawyer to take your divorce case pro bono. Instead, we recommend that you seek help from family and friends with the costs of your divorce. We also suggest that you try to work out some sort of reasonable retainer and payment plan with your divorce lawyer.

In the movie, according to Wikipedia, Carell plays a guy who is shocked to learn that his wife, played by talented actress Julianne Moore, wants a divorce. Ill-equipped for his new singles lifestyle, he reportedly becomes "wingman" to a cool "player," played by actor Ryan Gosling.

Can we be honest here? Frankly, I am not a big fan of The Office. But this new movie, which has some fine actors in it, appears to hold promise for a few laughs about an otherwise unfunny topic!

This past week, according to news reports, singer, actress, and American Idol Judge, Jennifer Lopez, and her husband, singer Marc Anthony, have reportedly separated. Lopez and Anthony, who have been married for seven years, have two children.

Divorce, Family Violence, and Bobbitizing It

Family, or domestic, violence is a real problem in this country. Far too many women, (and some men), suffer immeasurably at the hands of abusive spouses. As a result, in my opinion, getting a divorce should not be so costly, or difficult, that a spousal abuse victim will feel forced to take the law into their own hands.

According to reports, Ms. Bobbitt, after allegedly suffering for years as a victim of abuse and adultery, struck back by cutting off Mr. Bobbitt's penis, which was later re-attached by surgeons. As you will recall, Lorena Bobbitt was prosecuted, but later obtained a verdict of not guilty by reason of insanity. The couple subsequently divorced.

Now, this week, according to news reports, another woman, Ms. Catherine Kieu, of Garden Grove, California, has been charged with torture and aggravated mayhem, after allegedly tying down her estranged husband in a bed and cutting off his member with a kitchen knife. Unlike Ms. Bobbitt, who merely threw away the detached member, which was recovered and re-attached, Ms. Kieu allegedly tossed her spouse's penis down the garbage disposal and flipped the switch. The news reports are unclear as to what, if anything, could be re-attached.

Again, these cases illustrate some of the problems of family violence. Such cases also demonstrate that further violence, or going to prison, is not the answer. Seeing a divorce lawyer and getting a divorce is a better solution. Don't you agree? What is your opinion?

According to various news reports, Maria Shriver has finally filed for divorce this week from former California Governor, and actor, Arnold Schwarzenegger. Of course, we do not need to repeat here again all the salacious information "out there" about the former governor's adultery and love child. I am sure you are already familiar with it. This divorce filing appears only to be the latest stage in this ongoing celebrity separation and divorce saga.

One interesting new aspect of this case involves news reports that Ms. Shriver may be entitled, under California law, to an estimated $200 million from the marital estate. Of course, no doubt, both Schwarzenegger and Shriver will have good divorce lawyers to resolve such issues. And we can all be confident that divorce attorneys for each side will ensure that neither party will miss a meal after the divorce is final!
The State of Georgia, unlike California, is not a community property state. However, in Georgia divorces, generally, Georgia judges will nonetheless attempt to equitably divide marital property, if the parties cannot resolve it.

Okay, maybe it is time that I got back up on my soapbox to protest, once again, the Georgia General Assembly's increase last year in the amount for filing for a divorce in this state. (This terrible filing fee increase also applied to filing other types of civil lawsuits, too). Specifically, the increase in the divorce case court filing fee jumped from $80.00 to a whopping $205.00! Isn't that awful?

As Augusta, Georgia divorce attorneys, we try very hard to help our divorcing clients through a difficult time. We have also helped many people, as divorce lawyers, by working hard to keep our legal fees affordable. But we cannot change or help with the filing fees! This significant increase in the court costs for a divorce has made it even more difficult for many Georgians seeking one. Wouldn't it also be a terrible injustice if an abused wife must stay married, (and continue to get abused), simply because she cannot afford to get a divorce? It happens!

Something must be done to correct this injustice! Until that day comes, you can count on me to continue to climb back up on my soapbox to protest here!

According to various news reports, one of my favorite t.v. actors, Peter Falk, passed away yesterday at his California home. According to reports, Falk, 83, had suffered from dementia and Alzheimer's disease. Although he also was a star of screen and stage, Falk will always be best known for his incredible portrayal of "Columbo," the rumpled, one-eyed police detective. The popular detective television series lasted from 1971-1978; however, Falk also appeared in numerous t.v. specials as Columbo through 2003. Did you know that the talented actor was also an accomplished artist?

As Detective Columbo would conclude, "Just one more thing." Like many celebrities, Mr. Falk also experienced a divorce, back in 1976. But that's enough about that topic, here, today. Today, I primarily want to just salute the outstanding work and the life of a talented actor.

Fathers and Child Support Obligations

After all, not all fathers pay child support like they should. But as we approach Father's Day, perhaps it is important to recognize that most dads "out there," following a divorce, actually support their children, as they should, financially and otherwise. The "deadbeat dads" exist, but, fortunately, they are in a minority.

Indeed, according to one source, http://fathersrights.org/, 79.1% of fathers having limited visitation rights pay their court-ordered child support and 44.5% of those fathers having no visitation rights at all nonetheless still pay child support.

Of course, no one is suggesting that, simply because they pay child support, those fathers, (or any non-custodial parents), deserve any special reward. After all, those dads helped bring these kids into the world, too, and it is their legal and moral obligation to help support their children. Also, I'll bet that most of us would agree that the true "deadbeat dads" should be severely sanctioned. But sometimes, I believe it is also important to keep things in perspective, including the point that most non-custodial parents "out there" are, in fact, supporting their kids and doing the right thing! Just when we thought the Arnold Schwarzenegger adultery and separation saga had exhausted all its twists and turns, now, we hear reports that the former governor's housekeeper has agreed to an interview and reportedly discussed details of their relationship with the media. The housekeeper, identified in various reports as Patricia Baena, has even described how she allegedly broke the news of the affair to Maria Shriver. Also, photographs of the alleged love child are now reportedly circulating throughout the news media and internet. Where and when will it all end?

Doesn't it sometimes seem to you that news stories, like this one, and like the story involving Congressman Anthony Weiner, often develop a life of their own? And it appears that some in the news media keep fanning the flames. In other words, doesn't it appear that the news media will sometimes keep such salacious news stories alive with a constant daily drip of "new" information, so that they can simply sell more rags and generate high ratings?

The media frenzy also makes it much more difficult for celebrities than others who go through separation and divorce. Don't you agree?

A "D-Day" Tribute: June 6, 1944

As you know, we are divorce lawyers in Augusta, Georgia. I am also a former federal (and state) prosecutor in Augusta. Currently, I am a divorce attorney and criminal defense attorney.

Maybe some of you assumed that the above caption, which refers to "D-Day," meant that this is "divorce day." Actually, most of you probably know that "D-Day" refers to that important date, June 6, 1944, during World War II, when the allies landed on the coast of Normandy, France in the largest amphibious invasion in world history.

My late father was one of many brave Americans who fought on that morning at Omaha Beach. He was a medic and a member of the fighting Seabees. One can only imagine the horrors which he and others experienced there, sixty-seven years ago today. On this date, and every day, I am very grateful and very proud of him and all the other brave young men who fought for our freedom. We must never forget their devotion and sacrifices for all of us.

We have seen a lot in the news media lately about the topics of adultery and children being born out of wedlock. I would imagine some of you are immediately thinking about the case of former Governor Arnold Schwarzenegger. I have certainly posted here about issues presented by his separation and alleged infidelity lately! But, of course, Mr. Schwarzenegger is not the first wealthy man to admit to infidelity, or to get caught "running around," is he?

As Augusta, Georgia divorce attorneys, we often see allegations of adultery, cheating, or "fooling around." In this divorce law blog, we have also occasionally discussed the amount of proof which is necessary in order to prove adultery, which is a fault ground for a divorce in Georgia.

But just how common is adultery? According to once source, http://www.truthaboutdeception.com/, between 30% and 60% of all married people will commit adultery at some point. (Do you believe the actual number of cheaters is at the high end or low end of this range?) In addition, up to 3% of all children are allegedly the product of an adulterous relationship. And get this, according to this source, most of these children who are born out of wedlock are unwittingly raised by the married partner who is not their biological father.

I guess the point of this post is that, while we may read about celebrity adultery, these celebrities certainly did not invent it. "For better of for worse," adultery and children being born out of wedlock are quite common and occur in all parts of our society. They always have been and always will be. What do you think?

Yesterday, according to various news reports, a representative for former Governor Arnold Scwarzenegger announced that the actor and former governor will delay his film career comeback. Apparently, he is simply temporarily putting his acting career on hold while he deals with troubles associated with his separation from Maria Shriver, his wife of 25 years. At the same time, various news reports further indicate that Ms. Shriver has reportedly hired a California divorce attorney.

Who knows what might happen next in that ongoing salacious celebrity saga. But let's lay aside the specific facts of that situation and talk a little bit about similar issues confronted by other "regular folks" going through a divorce or separation.

Mr. Schwarzenegger's delay of his movie career illustrates a problem common to many separating or divorcing couples. Don't you agree that it would be tough -- both emotionally and time-wise -- for anyone to attempt to deal with a separation or divorce, while also attempting to juggle job pressures and deadlines? Just imagine how tough it would be for you to have to go to work every day, while also dealing with child custody and visitation issues, along with financial pressures common to most divorces? But the point is that, generally, most "regular folks" have no choice. They must deal with both -- the pressures of their split-up and their job pressures. Most folks cannot put their day jobs on hold.

So, arguably, while no separation or divorce is easy, at least the former governor can afford to take some time off while he confronts his personal life's challenges. That is good for him. But that is a luxury that many divorcing couples simply cannot afford. What do you think?

Back To Divorce Tip Basics: Documenting Everything!

Okay, okay! I realize that this is not merely a divorce blog about celebrity divorces and separations! Instead, I know that I am only an Augusta, Georgia divorce attorney who primarily focuses on writing about practical divorce tips for you to discuss with your own divorce lawyer! Maybe I have just gotten too carried away, recently, by all the big news reports coming out of California about the separation of former Governor Arnold Schwarzenegger and his spouse, Maria Shriver!

But today, let's get back to basics! Let's talk a little bit about the importance of documenting things while you are going through a divorce. (Of course, this post assumes that you have a private, secure place to make and keep a journal. Please first ask your own divorce lawyer about this issue before you do anything.)

For example, let's assume that you and your worthless spouse, "Sluggo," are going through a series of problems dealing with child visitation. The point here is that you should regularly document each of these problems in a journal, notebook, or some other writing. For instance, if Sluggo tells you, on Wednesday, that he will pick up the little darlings on Thursday, and then he fails to do so, and he doesn't even call you, then you should write it all down. Document it! Later, you can show your journal to your divorce lawyer. And don't you see the potential benefit? The important benefit is that, if you, unlike Sluggo, have documented, by date, each problem, or confrontation, then later, when you get to court, your attorney might very will be better prepared to prove your side of the case!

Can't you visualize your divorce attorney grilling your spouse on cross-examination? "Mr. Sluggo, isn't it true that, on February 12th, you agreed to pick up the kids on the 13th, and then you failed to show up?"

So, please consider, with your divorce lawyer, the idea of documenting all your encounters, or problems, with your spouse! Now, I wonder if there is anything else new in the Schwarzenegger separation!

Wow! Just when you thought things were bad enough for former Governor Arnold Schwarzenegger, we now hear the news reports today in which Schwarzenegger reportedly acknowledges a past alleged relationship with a former household staff member and that this relationship produced a love child a decade ago! You will recall that, earlier, this past week, the former governor and his wife of 25 years, Maria Shriver, had publicly announced their separation. Thereafter, we have now heard this stunning revelation today about the alleged cause of the celebrity couple's split.

Hopefully, the paparazzi will honor requests made by both Schwarzenegger and Shriver for privacy for her and the couple's four children. Of course, we can also hope that the media will also leave alone the former staff member and her child, too. But we won't hold our collective breaths, will we?

As we have seen before, it is bad enough when things like this occur in the marriage of any average citizen. And adultery, infidelity, cheating, "fooling around," or whatever you want to call it, do occur "out there," don't they? But perhaps the public scrutiny and, in particular, the relentless probing by the paparazzi, often only compound the problems in celebrity marriages. In many respects, this is a sad situation with complicated issues. Hopefully, the parties involved will be able to address the tough issues involved, as best they can. Don't you agree?

I hope you don't mind if I, as a proud father, boast a little bit again today about my four children! As you may know, currently, I practice law in Augusta, Georgia with my oldest son, Richard H. Did you hear the latest celebrity news from California? According to various reports, actor-former Governor Arnold Schwarzenegger and his spouse, Maria Shriver, have separated. Of course, with the former governor moving back into acting, after a busy political career, this is a time of stressful transition for the couple. According to reports, they have been married for 25 years and have four children.

At this time, the couple has reportedly only separated. Divorce has not been publicly mentioned. Only they should know about or decide what happens next. Celebrity Divorces: Marie Osmond

Have you heard the news reports about popular singer Marie Osmond? According to various reports, earlier today, she remarried her first husband, Stephen Craig, in Las Vegas, (where she is currently performing with her celebrity brother, Donnie Osmond). Significantly, Ms. Osmond and Mr. Craig had been married before, in 1982, and then they had divorced, in 1985. The couple had one child, who is now reportedly 28 years old. Ms. Osmond also had another previous marriage to another man, prior to today's remarriage, which had also ended in divorce, about four years ago.

According to http://www.healthcareinfo.org/ and other sources, roughly 55% of men and 44% of women over the age of 25 generally remarry after a divorce. Of course, one can reasonably guess that only a small percentage of men and women end up remarrying their former marriage partners after a divorce. After all, unlike in Osmond's case, if you ever get free of your own worthless spouse, "Sluggo," you aren't likely to want to get hitched with that ole' nag again!

Celebrity Divorces: James Brown

Today is the birthday of James Brown, the late, great singer and "Godfather of Soul!" Brown, who grew up in Augusta, Georgia, (where I am a divorce lawyer), was born on this date in 1933. The still popular American icon died on December 25, 2006. While alive, Brown was noted for being "the hardest working man in show business." Locally, Brown was also well respected for his charitable work, including an annual turkey give-away each Thanksgiving. Brown never forgot where he came from!

Like many celebrities, James Brown also experienced some marital problems, which, according to Wikipedia, resulted in two divorces.

But today, as an Augusta, Georgia lawyer, who is proud to be "living in America," (which is the name of one of Brown's biggest hits), and who is also happy to live in Mr. Brown's hometown, I mainly just wanted to recognize him on his birthday! Happy Birthday, James Brown!

Divorce, Judicial Discretion, and Square Rocks

On my desk, at The Goolsby Law Firm, LLC, located in Augusta, Georgia, sits this square rock! (I guess that, technically, the rock would be considered a cube)! What does a square rock have to do with a divorce-related blog? Consider the following point.

Although family law judges generally follow guidelines which normally apply to most divorce or child custody cases, it is important to recognize that they also generally retain some discretion to deviate from the norm. And there is a good reason for this judicial discretion. Simply put, not all people and not all divorce cases are alike. Just as most rocks are round, occasionally, you run across one that is square! For instance, Georgia's child support guidelines might dictate that a parent should pay a certain prescribed amount of child support. However, a judge is granted discretion to deviate from the prescribed amount if, for example, the parent is temporarily unemployed, or otherwise has lower income.

Frankly, as a divorce attorney, I am glad that judges retain some discretion to depart from the norm. After all, not all of us rocks are round! Don't you agree?

Have you read the news reports about the interesting issues which a divorce is presenting to the Los Angeles Dodgers and Major League Baseball? In this case, the divorce involves the Dodgers' owners, Frank and Jamie McCourt. According to various reports, the McCourts have been fighting, as part of their divorce, over a division of this "major league marital asset." Now, the Commissioner of Major League Baseball, Bud Seilig, has stepped in, according to reports, and essentially taken over the team. A trustee will reportedly be appointed to oversee the team, at least while the litigation is pending, or possibly until the team is sold to new owners.

Divorces can get really complicated, particularly in cases in which the divorcing parties have operated a business together. In this case, the business at issue just happened to be one of the largest, most famous franchises in the world! Arguably, it would be about as difficult to divide a baseball team franchise as it would be to divide a baseball! It will be interesting to see what happens next!

1. New Reports About Apple's iPhone Tracking Your Location:

More specifically, various news reports indicate that Apple's iPhone4 keeps track of everywhere you go and stores this information in an unencrypted file. This file can reportedly be easily accessed by any device with which you synchronize your phone! Why did Apple do this? We still don't know. Apple still has not responded to inquiries about why this data is being stored on its hot new phone. But all of us who are interested in freedom and our right to privacy should be concerned.
2. Possible Impact on your Right to Privacy and Proof of Adultery:

After all, consider the wide range of possible threats to your privacy. For instance, if you have a phone, the government, or the police, could determine with whom you have met, or where, even without a search warrant. And, your worthless spouse, "Sluggo," had better not forget that, in divorce cases, divorce attorneys could more easily determine with whom you have met, and could more easily prove adultery, too!

The point is that, once again, we have seen that technology, in spite of its wonderful benefits, can also represent a threat to our basic freedoms, too. So, Sluggo, if you are going to cheat, you had better leave your phone at home!

Folks, what is going on with Hollywood actors these days? This is a humble divorce blog written by an Augusta, Georgia divorce lawyer. Here, in past posts, we have often dealt with some of the domestic relations challenges faced by various celebrities. The common theme has been that celebrities often face the same family law problems confronted by ordinary people. But somehow, it seems to me that, lately, things have really gotten unusually bizarre in Hollywood!
1. The Nicolas Cage Incident:

For example, a few days ago, one of my favorite Hoolywood actors, Nicolas Cage, was reportedly arrested in new Orleans on charges of disorderly conduct and domestic abuse.
2. The Latest Charlie Sheen Case:
And just yesterday, according to TMZ and other news sources, actor Charlie Sheen and one of his exes, Brooke Mueller, reportedly returned to court to address Sheen's request for a change of custody of their children. According to various reports, the judge reportedly maintained the status quo, (and left the kids with Mueller), in spite of the alleged reports, or accusations, about drugs involving each of the parties.

Of course, no one really knows what happened in either of these celebrity cases. News reports sometimes get the facts wrong, don't they? Also, we should generally accept such "news" reports with a jaundiced eye, anyway. Don't you agree?

But I'll bet you will also agree that, no matter what really happened in either of these cases, there appear to be some strange "goins on" in Hollywood these days!

This is another post in our ongoing series about practical tips for you to consider when looking for a divorce attorney. As most of you know, I am an Augusta, Georgia divorce lawyer who practices law with my oldest son. Today, let's focus on two ways to find, or select, a good divorce attorney: first, the more traditional route of "letting your fingers do the walking in the yellow pages," and second, the growing trend of searching the internet for a good lawyer.

1. THE OLD FASHIONED METHOD OF FINDING ATTORNEYS: LOOKING THROUGH PHONE BOOK ADS:

We talk frequently with clients and with other divorce lawyers about how people find their divorce attorneys. Frankly, while the trend may be toward searching through various internet advertisements, the good old-fashioned telephone book method still remains a common way in which many people still find their attorneys. If this is the route you choose to go in finding your divorce attorney, then I recommend that you look for lawyers, (like us), who offer a free intial consultation. Also, as we have emphasized before, you will still need to actually meet with your prospective divorce lawyer and "eyeball them," in order to ensure that he or she is the best lawyer for you!

2. THE TREND TOWARD FINDING (DIVORCE) LAWYERS VIA THE INTERNET:

Without question, the trend is in the direction of finding a good divorce attorney via the internet. Most divorce lawyers realize this, too. As a result, there are an incredible number of internet sites featuring divorce attorney listings, along with specific divorce law firm websites, too. Frankly, as a practicing divorce lawyer, it makes it difficult to decide WHICH internet divorce lawyer listings we should pay to join! If you want to see what I mean, then simply google the words "divorce attorneys" and the name of your city! The list of potential lawyers clamoring for your attention would choke a horse!

But please also again remember this final point: No matter which method you use to find a good divorce lawyer, you should always first meet with that lawyer and size them up before you retain them to represent you in your divorce case!

Sad News About Domestic Abuse and Safe Homes

Did you hear the sad news out of the State of New York? According to various news reports, a woman has reportedly driven her mini-van into the Hudson River and drowned, along with three of her four kids. Only one of the children has reportedly survived. While the reported facts remain unclear, according to reports, this tragedy was allegedly connected to an incident involving domestic violence. Such incidents are sometimes a tragic part of divorces, too, aren't they?

At the same time, I have been following news reports in my state, the State of Georgia, that shelters for abused women face severe cutbacks, if not elimination, of state funding next year. As you know, such homes, including fine shelters such as Safe Homes of Augusta, offer abused women an alternative to either staying in abusive situations, or to doing something unfathomable, as perhaps occurred in the New York case.

Again, no one really knows all the facts in the New York case. And perhaps we would disagree about possible solutions in some cases. But hopefully, we can all agree that we need to support shelters for abused women, either through tax dollars, or through charitable donations.

Celebrity Divorces: Elizabeth Hurley

Have you heard the news about talented actress Elizabeth Hurley? According to various news reports, Ms. Hurley has filed for a divorce this week in London from her husband, Arun Nayer. The couple had married in 2007. Of course, everyone also remembers Ms. Hurley as the former girl friend of actor Hugh Grant.

Over the years, Elizabeth Hurley has portrayed a number of movie villains, including her portrayal of Delilah, (in Samson and Delilah), and the Devil, (in Bedazzled). Ms. Hurley has also reportedly been cast as the villain in the upcoming Wonder Woman t.v. series.

However, in real life, Elizabeth Hurley is no villain! No one can surpass her heroic work, as a volunteer for various children's charities, and in her noble fight against breast cancer, (as shown in the above recent photograph, taken at a charitable event for the Breast Cancer Research Foundation, (see Wikipedia).

As we have seen before, divorce knows no boundaries. Divorce can strike both the celebrity and the average citizen -- the hero and the villain. In the case of Ms. Hurley, a real hero, in my book, hopefully, she will overcome her current problems and find happiness.

In the last post, we talked a little bit about the importance of finding a good divorce attorney to represent you in your divorce. Of course, we are Augusta, Georgia divorce lawyers, so we talk with potential divorce clients every day. Here are a few important things for you to consider when looking for a good divorce lawyer.
1. How To Find A Divorce Lawyer, In Augusta, Georgia, Or Elsewhere:

One divorce client paid me a tremendous compliment recently! She told me about her efforts to find a good, experienced divorce attorney, here in Augusta, Georgia. For instance, she had talked with family members and friends and had gotten their input about various Augusta lawyers. She had also checked out a number of Augusta divorce lawyers' websites. But then, she did more. She called us, made an appointment for a free consultation, and met with us. She then later told me that the primary reason why she had selected The Goolsby Law Firm, LLC to represent her in her divorce was because she had met us and liked us. In other words, after meeting my son and me, and after discussing some of the issues in her divorce case with us, she felt comfortable that we would be good advocates and a good fit for her!

So, today, I want to ask you to consider the following simple question: What do you think about lawyers? As you know, we are Augusta, Georgia divorce attorneys. This is a continuing series on the topic of how do you plan for a divorce. In other words, what are some of the practical things you should consider when planning for a divorce? In earlier posts in this series, we have suggested that you should gather your financial records, e.g. pertaining to income and retirement accounts. We have also suggested that you should plan a budget and decide what you want to do with your marital home. Of course, you should discuss each of these issues with your own divorce lawyer.

Today, I want to talk a little bit about another idea for you to consider when planning for a divorce:

4. MAKE A LIST OF PERSONAL PROPERTY YOU WANT TO KEEP:

In many uncontested divorces, the parties can and will agree on how to divide all personal property. In such cases, neither party may be required to prepare a list of personal property which he or she wants to keep. But if you want the security of knowing that you, and not your worthless spouse, "Sluggo," will be able to keep your granny's old sewing machine, then you might consider preparing a list of property you get, and then ask your divorce attorney to make the list a part of your settlement agreement. This may help reduce, or eliminate, mistake or confusion later, about who gets what personal property, if Sluggo decides to break bad on you!

Of course, you probably do not need to put on any checklist that Sluggo gets to keep your mother-in-law! Some things just go without saying, even in divorce law!

Divorce and Television Shows: "The Exes"

Yesterday, we discussed the new proposed t.v. show, Happily Divorced, which will star The Nanny, (the talented Fran Drescher).

Today, I want to tell you about another new t.v. show about divorce which is also slated to premiere soon. This program, called The Exes, will star Seinfeld alumnus Wayne Knight, (the infamous Newman!). According to new reports, the show is about three divorced men who live together in an apartment, across from their divorce attorney, (who will be played by a talented actress, Kristen Johnston, from 3rd Rock From The Sun).

The t.v. program Seinfeld is one of my favorite sitcoms of all time. The character, Newman, played by Knight, was a classic! Of course, I am also a fan of Knight because he attended the University of Georgia, around the same time I was there!

Here's hoping that The Exes will be an entertaining show about divorce and that Wayne Knight will have another career hit!

Divorce and Television Programs: "Happily Divorced"

Did you hear about the new t.v. sitcom, Happily Divorced, starring actress Fran Drescher, (The Nanny), which is slated to premiere later this year? In the new sitcom, Drescher plays a character who is returning to single life after discovering her husband is gay. According to various news reports, the premise of the sitcom is based upon Ms. Drescher's own life. As an Augusta, Georgia divorce attorney, and as a fan of Drescher, I look forward to giving this new t.v. show a shot! How about you?

Celebrity Divorces and Reconciliations: Billy Ray Cyrus and Acky-Breaky Hearts

Did you hear the good news out of Hollywood? According to various news reports, country music singer Billy Ray Cyrus and his spouse have reconciled and reportedly dismissed their divorce case! Also, Cyrus has announced that he and his actress-singer daughter, Miley Cyrus, have also reportedly patched up any problems or issues between them and that they are getting along better than ever--better than before their Hannah Montana days, according to Cyrus.

We have all heard (and discussed here) about so many Hollywood marriages ending up on the rocks. Here's hoping that this Hollywood marriage and some really nice folks--the Cyruses--will overcome their past "acky-breaky hearts" and find happiness together!

Divorce Checklist: Planning For A Divorce

A couple of posts ago, I began this "series" called a "Divorce Checklist: Planning For A Divorce." We gave you a couple of tips to consider when planning for a divorce. Here is another practical tip concerning how to dispose of the marital home for you to discuss with your divorce attorney, as you plan for your divorce from your worthless spouse, "Sluggo!"

3. PLAN HOW TO DEAL WITH OR DISPOSE OF THE MARITAL HOME:

Let's assume that you and your spouse own a home together. In other words, both you and your spouse are "on the hook" to the bank for the mortgage. The common issue is: How do you dispose of a marital home when faced with the prospect of a divorce. There are several ideas for you to discuss with your own divorce lawyer. For example, if you want to keep the marital home, you should evaluate whether or not you can afford the payments and upkeep, (even when factoring in alimony and/or child support you should receive). Also, even if you want to keep the house, and kick Sluggo out, you will also need to consider whether or not you are able to refinance the home mortgage into your own name. In other words, as we have discussed before, the bank doesn't care whether you and Sluggo stay married or get a divorce. All they care about is that they presently have BOTH of you on the hook for the mortgage. And they aren't likely to let one of you simply walk away! Therefore, in order to truly get rid of Sluggo, but keep the house, you will need to consider refinancing the house into your own name. If you can't qualify for a refinance, then you might consider asking a qualifying parent to co-sign with you. In the alternative, if neither you nor Sluggo want or can't afford the house, then you should discuss the idea with your divorce attorney of selling the house and how to equitably divide the sale proceeds.

Every divorce is different. Every divorce presents special challenges. Some of these marital home scenarios might not apply in your divorce case. Therefore, it is important to emphasize that you should always discuss all the issues concerning how to dispose of the marital home with your own divorce attorney. Of course, how to properly deal with good ole' "Sluggo" is another important topic of discussion, too!

Of course, you don't have to be a divorce lawyer to realize that it might be helpful, if you are contemplating a divorce, for you to take steps to be prepared for it. Here are a couple of practical tips for you to consider and for you to discuss with your own divorce attorney:

1. GATHER FINANCIAL RECORDS:

If you are seriously considering a divorce, then you need to begin gathering all your financial records. For instance, go ahead and try to put your hands on copies of your house deed, car titles, job earnings statements, (for both you and your spouse), credit card and loan documents, and copies of retirement account statements. These documents will help you and your divorce lawyer to size up your financial situation, as you plan for your divorce.

2. PLAN A BUDGET:

If you are thinking about getting a divorce, you also should sit down and plan a budget composed of what your expected monthly living expenses will be following the divorce. Although some items, such as rent, groceries, or utilities, will be difficult to project, (especially if you are uncertain about where you will live), preparing a budget will at least help you to begin the process of estimating how much you will need to get by on. Then, you will be in a better position to know how much money you will need to seek when you begin to discuss alimony, property division, and child support issues with your divorce attorney.

Divorce, Child Custody and Parent Selection

Today, let's talk a little bit about parent selection in a Georgia child custody case.

Did you know that, in Georgia, generally, a child who has reached 14 years old may sign a parent selection form and essentially choose with whom he or she wants to live? Of course, the judge might still potentially ignore the kid's custody selection. Moreover, the judge will still ultimately decide what is in the child's best interests. But it is important that you know that, at least in the State of Georgia, parent selection is still possible.

In this 2002 comedy, Ms. Witherspoon's character, Melanie Smoot, returns home to Alabama, from her new life as a New York City socialite, in order to finalize her divorce from the home town boy, played by Josh Lucas. The movie also features some other fine performances by actors Candice Bergen, Jean Smart, and Mary Kay Place.

According to reports from various sources, singer Billy Ray Cyrus has blamed his daughter's (and his) television show, Hannah Montana, for his divorce and for the problems which he believes his daughter, Miley Cyrus, is currently facing. What is your opinion? Could the stressors of a t.v. show cause such serious family problems?

At first blush, some might think Mr. Cyrus may simply be making excuses. However, in my opinion, maybe we should give him the benefit of the doubt. You must admit that being in a Hollywood fish bowl would put stress on any marriage and would complicate raising any teenager.

But no matter what the answer may be, here's hoping that, with good, loving parents like Billy Ray Cyrus and his ex-wife, Tish, their daughter, Miley Cyrus, will avoid the pitfalls being faced by Lindsay Lohan and will mature into a fine, responsible adult!

Did you hear the news? Another Hollywood marriage apparently bit the dust! According to various news reports, singer Ashlee Simpson, (who is the sister of Jessica Simpson), has reportedly filed for divorce in Los Angeles from her husband, musician Pete Wentz. The couple, who were married in May, 2008, reportedly have a two year old son. Ms. Simpson, you will recall, was the hot topic of discussion back in 2004 when her alleged lip synch performance went awry on Saturday Night Live.

Here's hoping that this young couple is able to deal with and overcome the various issues in their divorce soon!

Adultery and Divorce: Will You Go to Jail AND to Hell?

Have you ever seen a sign like this one? The sign pictured above, about the eternal, everlasting consequences of adultery, reportedly appears outside a Texas church. But laying aside the question of what God will do to you, if you commit adultry, have you ever wondered whether or not adultery constitutes a criminal law violation, too? In other words, could your worthless spouse, "Sluggo," go to jail, (as well as to Hell), if he cheats, too?

The answer depends, in part, on which state you live in. In other words, not every state still criminalizes adultery, infidelity, or cheating. So, you would need to consult with a divorce attorney, (or a criminal defense lawyer), in your state to get a definitive answer to this question.

1. GEORGIA CRIMINAL LAW AND ADULTERY:

But I can tell you a little bit about Georgia law. (As you know, I am a divorce lawyer in Augusta, Georgia. I also was a state and federal prosecutor before I went into private practice and became a divorce lawyer with my oldest son). As to cheating and "running around" in the State of Georgia, I can tell you that, based upon my experience as a former prosecutor, while adultery is technically still "on the books" as a crime in this state, it is rarely enforced by prosecutors.

2. GEORGIA DIVORCE LAW AND ADULTERY:

Of course, even if you don't go to jail, you should also know that adultery is nonetheless a fault ground which may have a devastating impact on your divorce, including its potential impact on issues involving child custody, alimony, and property division. So, please don't read this post and think, for even a minute, that adultery won't cause you, or Sluggo, any problems!

After all, it might also be your misfortune that your local D.A. may decide to dust off the criminal law books and make you an example by prosecuting you for committing adultery! As always, please consult with your own divorce attorney about your situation and about the impact of adultery in your case.

Here's also hoping that Sluggo will straighten up before God or the D.A. get him, too!

As you know, Ms. Kidman has found success and happiness since the divorce from Cruise. She is currently a nominee for an Academy Award. Also, she is now happily married to Country singer Keith Urban. And you would not believe all the incredible charitable work she does!

Favorite Movies About Divorce: "It's Complicated"

Even though this is a blog by an Augusta, Georgia divorce attorney about Georgia divorce, I really don't want to talk about Georgia divorce or divorce tips today! After a number of relatively dull posts about divorce and divorce law tips, let's have a little fun today with another post about favorite movies about divorce! Have you seen the 2009 divorce movie, "It's Complicated?" If not, you should try it! This movie stars the inimitable Meryl Streep, along with Alec Baldwin and one of my favorite comedians, Steve Martin. This movie deals with a real-life situation in which a spark reignites the passion between a divorced couple, (portrayed by Streep and Baldwin). To further complicate matters, in the movie, Baldwin's character has re-married another young woman! Don't worry--I won't spoil the ending for you! But rest assured, it's not too complicated by the end of the flick!

Joint Custody or Shared Custody: By Either Name Does It Really Work?

According to Divorce Lawyer Source and other sources, only about twenty percent of all divorces involving child custody result in a shared (or joint) custody arrangement. Put another way, as you would suspect, in most divorce cases, one parent, (usually, the mother), gets sole physical custody and the other parent, (usually, the father), gets reasonable child visitation.

As Augusta, Georgia divorce attorneys, we, (at The Goolsby Law Firm, LLC), have seen both arrangements work. In other words, while our experience with child custody has probably followed the norm, we have seen that shared (joint) child custody can work in some situations. Each case is different. But while shared (joint) custody may work for some families, it is simply not very practicable in others. One practical issue involves challenges faced by school-aged children who are expected to go from one parent's house to another, from week to week. Can't you see the problems such a child might face? In other words, there are many practical issues which you must discuss with your divorce lawyer before agreeing to a shared (joint) child custody arrangement.

Divorce and How Not To Prove Adultery!

All the divorce courts in the world must wait and wait -- to see what happens next in the ongoing saga of Michigan resident Leon Walker, who has been charged with a felony for allegedly hacking into and checking his wife's email. According to various news reports, Walker was seeking evidence to prove his wife's alleged adultery. Of course, no one should pre-judge what has happened or what should happen in that criminal case. That job is best left up to the Michigan judges, prosecutors, and criminal defense attorneys.

However, this Michigan case does raise some other important issues for you to discuss with your own divorce lawyer. For example, let's assume that you suspect your worthless spouse, "Sluggo," of cheating on you. Based upon the Michigan case, it should now be clear to you that you shouldn't hack into his email accounts. We get that! But have you also considered that it might also be dangerous for you to tap Sluggo's phone, too?! In other words, even if you strongly suspect that Sluggo is "sweet talking" on the telephone with his new honey, it isn't worth running the risk of going to jail over by surreptitiously recording Sluggo's telphone conversations with others. That's likely a felony, too! So, please understand that it is imperative for you to discuss these issues about how to prove (and how not to prove) adultery with your own divorce attorney!

After all, retaining a divorce lawyer is tough enough, but, like Mr. Walker, you don't want to have to retain a criminal lawyer, too!

Divorce and Property Division: How To Dispose of the Marital Home

Today, as an Augusta, Georgia divorce lawyer, I want to talk a little bit about some of the practical points to consider when dealing with the disposition of a marital home in a divorce. As you can see, I chose a photograph of the White House to illustrate this post! Fortunately, for the President, his marriage appears to be pretty solid! But even if his marriage hit the rocks, at least he wouldn't have to worry about how to deal with the disposition of this "marital home!"

But maybe you aren't so fortunate. Perhaps you are going through a divorce and you must confront the question of what to do about the marital home, especially since there is no way that you and your worthless spouse, "Sluggo," can continue to live under the same roof! What should you do?

Laying aside some of the obvious questions, such as how to decide who should get the marital home, and how do you sell a house in today's frigid housing market, here are a couple of other important points for you to consider and to raise with your own divorce attorney:

1. IF SLUGGO WANTS TO KEEP THE HOUSE: Let's assume that the home mortgage is in both of your names. Even if your spouse wants to keep the house, and even if you are willing to let him do so, it is important that you make sure the settlement agreement provides that he has a deadline within which to refinance, to take your name off the mortgage, and to pay you your fair share of the equity. You would be surprised at how many people we talk with, as Augusta, Georgia divorce attorneys, who have not considered these important issues!

2. IF SLUGGO CANNOT REFINANCE THE HOUSE: In the event that Sluggo cannot, or does not, refinance the home mortgage within the allotted time, you should also discuss with your divorce lawyer the idea of including in your settlement agreement a default provision providing that, following the refinancing deadline, the home must be listed and sold. Also, you and your divorce attorney could include some language providing for appraisals and methods to arrive at a fair sale price, in the event that you and your spouse cannot agree on it.

Again, the point of this post is that you should discuss with your own divorce attorney some of the ways to accomplish selling the marital home, getting your name off the mortgage, and obtaining your fair share of the home equity. Celebrity Divorces: Reese Witherspoon and Ryan Phillippe

In my opinion, American actress Reese Witherspoon is one of the finest actors and finest people in Hollywood today. For instance, her award-winning performance as June Carter-Cash in Walk the Line was, in my opinion, a true movie classic. Also, you would be amazed at all the incredible charitable work done by Ms. Witherspoon, who is clearly one of "America's Sweethearts." But that is not the point of this post in a blog written by an Augusta, Georgia divorce attorney!

The point of this post is that Ms. Witherspoon, along with her ex-husband, actor Ryan Phillippe, whom she divorced in 2007, serve as good examples of how life should go on after a divorce. For example, the two actors have remained friendly after their divorce. Recently, after Ms. Witherspoon's engagement to Hollywood agent Jim Toth, was announced, Mr. Phillippe was among those who wished the new couple well.

In addition, this couple illustrates that, while divorce can be painful for anyone to experience, it can be overcome. In other words, life goes on. You can still find happiness and a rewarding career after a divorce.

Husband Faces Hacking Charges For Checking Wife's Email!

Have you heard the news? Various news outlets have reported that a Michigan man faces felony anti-hacking charges because he checked his wife's email on a family computer! The emails reportedly revealed that she had been having an affair. What is your opinion about a prosecutor bringing criminal charges in this divorce context?

As divorce attorneys in Augusta, Georgia, we have warned you before about this very possibility. You must be careful about how you attempt to prove adultery. In other words, even if you suspect your spouse of committing adultery, we have always recommended that you should carefully discuss with your own divorce lawyer the proper ways to obtain the evidence of infidelity. More simply put, as any attorney will tell you, you should always use legitimate means to prove your worthless spouse, "Sluggo," is cheating, because he isn't worth going to jail over!

Of course, it remains to be seen whether or not the Michigan man violated any anti-hacking laws or did anything wrong. Celebrity Divorces: Kelsey Grammer, Camille Grammer and Lessons about Prenups!

What is your opinion about prenuptial agreements, also known as "prenups?" Would you require your sweetheart to sign one, as a pre-condition of marriage, or would you be afraid it would zap the romance in your relationship?

Well, I'll bet that popular actor Kelsey Grammer, of Cheers and Frasier fame, wishes that he had been more diligent about getting his soon-to-be ex-wife, Camille, to sign one, prior to their 13 year marriage, (which is still being litigated in divorce court). Various news reports indicate that the Grammers did not have a prenup and that, as a result, she stands to share, 50-50, marital assets worth over $100 million! Of course, in fairness to her, news reports further indicate that she deserves credit for helping the couple to make good investments of his money from his successful t.v. shows.

News reports also indicate that Kelsey Grammer may have his divorce attorneys ask the judge in his divorce case to go ahead and grant a divorce, even if the financial issues have not yet been resolved. Reportedly, he wants to go ahead and get married to his new girl friend on New Years Day!
